1. Introduction
Welcome to My Feline. These Terms and Conditions ("Terms") govern your access to and use of the My Feline mobile application ("App") and any related services provided by My Feline, a Trading Division of Kuba & Leia Limited (Company No. 11005503, DUNS No. 223417185), registered at 45 Station Road, Henley on Thames, Oxfordshire, RG9 1AT, United Kingdom ("we", "our", "us").
By downloading, accessing, or using our App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the App.
2. Eligibility
By using the App, you represent and warrant that:
- You are at least 16 years of age
- You are a resident of the United Kingdom
- You have the legal capacity to enter into a binding agreement with us
- You will use the App in accordance with these Terms
3. Account Registration
To use certain features of the App, you must register for an account. When you register, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Not share your account credentials with any third party
- Notify us immediately of any unauthorised access to or use of your account
You are solely responsible for all activities that occur under your account. We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or incomplete.
4. Use of the App
4.1 Permitted Use
You may use the App for your personal, non-commercial use only. You agree to use the App only for lawful purposes and in accordance with these Terms.
4.2 Prohibited Use
You agree not to:
- Use the App in any way that violates any applicable law or regulation
- Impersonate any person or entity or misrepresent your affiliation with a person or entity
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the App
- Use the App for the purpose of exploiting, harming, or attempting to exploit or harm minors
- Attempt to gain unauthorised access to, interfere with, damage, or disrupt the App or the servers or networks connected to the App
- Upload or transmit viruses, malware, or other malicious code
- Collect or harvest any information from the App
- Use the App for any commercial solicitation purposes without our express consent
5. User Content
5.1 Content Ownership
The App allows you to upload, submit, store, or share content, including but not limited to text, images, and videos of your cats ("User Content"). You retain any ownership rights you have in your User Content.
5.2 Content Licence
By uploading, submitting, storing, or sharing User Content on the App, you grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content for the purposes of:
- Operating and improving the App
- Providing the features and services of the App
- Conducting research as described in our Privacy Policy
This licence terminates when you delete your User Content or your account, except where:
- Your User Content has been shared with others and they have not deleted it
- Your anonymised User Content has been used for research purposes as described in our Privacy Policy
5.3 Content Responsibility
You are solely responsible for all User Content that you upload, submit, store, or share on the App. By submitting User Content, you represent and warrant that:
- You own or have the necessary rights to share the User Content
- The User Content does not infringe upon the rights of any third party
- The User Content complies with these Terms and all applicable laws and regulations
We reserve the right to remove any User Content that violates these Terms or that we find objectionable for any reason, without prior notice.
6. App Features
6.1 Pawtfolio
The Pawtfolio feature allows you to create and maintain digital profiles for your cats. While we strive to provide a secure platform for storing this information, you are responsible for the accuracy and completeness of all information provided.
6.2 Library
The Library feature provides access to feline research and information. While we aim to provide accurate and up-to-date information, we do not warrant the completeness, reliability, or accuracy of this content. The information is provided for general education purposes only.
6.3 Your Area
The Your Area feature uses your postcode to show cat-related businesses and services near you. We do not endorse or guarantee the quality of any businesses listed. Your use of any services discovered through this feature is at your own risk.
6.4 Symptom Checker
6.4.1 Information Only
The Symptom Checker and all health-related content within the App ("Health Information") are provided for informational and educational purposes only. The Health Information is not veterinary advice, diagnosis, or treatment, and does not establish a veterinarian-patient relationship.
6.4.2 Human-Supervised Analysis
The Symptom Checker uses a combination of AI tools, peer-reviewed veterinary research, and human review. When you submit symptoms, a trained member of the My Feline team reviews your responses and uses AI-assisted tools to analyse the information against patterns from veterinary science. This human-supervised approach ensures the analysis appropriately considers the specific details you have provided before any results are shared with you.
The system generates suggestions to help you understand potential conditions, but these should not be interpreted as a definitive diagnosis. The accuracy of suggestions depends on the completeness and accuracy of the information you provide.
6.4.3 No Warranties
THE HEALTH INFORMATION IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. MY FELINE EXPLICITLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AVAILABILITY, SECURITY, COMPATIBILITY, AND NONINFRINGEMENT.
6.4.4 Assumption of Risk
You acknowledge that any reliance upon the Health Information is at your own risk. My Feline does not warrant that the Health Information will meet your requirements or expectations or that it will be error-free, timely, reliable, or free from interruptions or other failures.
6.4.5 Prompt Veterinary Care
You acknowledge that you should promptly see your veterinarian for all matters related to your cat's health. In particular, the Symptom Checker is not designed to identify all potential health concerns and should never be used in place of emergency veterinary care.
6.4.6 Emergency Symptoms
Each Symptom Checker survey begins with a question listing serious or life-threatening symptoms that require immediate veterinary attention (such as difficulty breathing, collapse, seizures, or suspected poisoning). If you select any of these symptoms, the survey will not continue and you will be directed to seek veterinary assistance immediately. You can only proceed with the survey by confirming that none of these emergency symptoms apply. You should never delay seeking emergency care if your cat is showing signs of a serious condition.
6.5 Research (in development)
The Research feature allows you to opt in to participate in paid research opportunities. Participation is entirely voluntary. You may withdraw from any research study at any time, but payment will only be made upon full completion of the research project.
6.6 Subscriptions and Payments
6.6.1 Subscription Plans
My Feline offers subscription plans that provide access to premium features. Current pricing and plan details are displayed in the App before purchase. We reserve the right to modify subscription pricing with reasonable notice to existing subscribers.
6.6.2 Auto-Renewal
Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled at least 24 hours before the renewal date. The renewal charge will be made to the payment method associated with your Apple App Store or Google Play account.
6.6.3 Cancellation
You may cancel your subscription at any time through your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until your subscription expires. My Feline cannot process cancellations directly - you must cancel through the store where you purchased your subscription.
6.6.4 Refunds
Refund requests are handled by Apple or Google according to their respective refund policies. To request a refund, contact Apple App Store Support or Google Play Support directly. We do not have the ability to process refunds for purchases made through the app stores.
6.6.5 Price Changes
We may change subscription prices from time to time. Any price changes will apply to billing periods starting after the change. We will provide reasonable notice of price changes, and you may cancel your subscription before the new price takes effect.
7. Intellectual Property
7.1 Our Intellectual Property
The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by us, our licensors, or other providers of such material and are protected by UK and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
7.2 Licence to Use the App
Subject to these Terms, we grant you a limited, non-transferable, non-exclusive, revocable licence to download, install, and use the App for your personal, non-commercial use only.
7.3 Restrictions
You must not:
- Modify copies of any materials from the App
- Use any illustrations, photographs, or graphics separately from the accompanying text
- Delete or alter any copyright, trademark, or other proprietary notices
- Access or use for any commercial purposes any part of the App or any services or materials available through the App
8. Limitation of Liability
8.1 General Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MY FELINE, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE APP, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE APP OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.
8.2 Health Information Limitation of Liability
IN ADDITION TO THE GENERAL LIMITATION OF LIABILITY, MY FELINE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF MY FELINE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM YOUR USE OF OR INABILITY TO USE THE HEALTH INFORMATION.
8.3 Cap on Liability
To the extent that any limitation of liability in these Terms is found to be unenforceable, our total liability to you for all damages, losses, and causes of action shall not exceed the amount you have paid to us in subscription fees during the twelve (12) months immediately preceding the claim, or £50, whichever is greater.
8.4 Exclusions
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
9. Indemnification
You agree to defend, indemnify, and hold harmless My Feline, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App, including, but not limited to, your User Content, any use of the App's content, services, and products other than as expressly authorised in these Terms, or your use of any information obtained from the App.
10. Third-Party Content and Links
The App may contain content provided by third parties, as well as links to third-party websites or services. We are not responsible for the content, policies, or practices of any third-party websites or services linked to or from the App. Your use of such third-party websites or services is at your own risk and subject to the terms and conditions of such third parties.
11. Modifications to the App and Terms
11.1 App Modifications
We reserve the right to withdraw or modify the App, and any service or material we provide on the App, in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the App is unavailable at any time or for any period.
11.2 Terms Modifications
We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the App thereafter. For material changes, we will notify you through in-app notification and/or email. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.
12. Termination
12.1 Termination by You
You may terminate your account at any time by using the Delete Account option in the App (Settings > Account > Delete Account) or by emailing support@my-feline.com. If you have an active subscription, remember to cancel it through your app store before deleting your account to avoid future charges.
12.2 Termination by Us
We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.
12.3 Effect of Termination
Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
13. Governing Law and Jurisdiction
These Terms and your use of the App will be governed by and construed in accordance with the laws of England and Wales, without giving effect to any choice or conflict of law provision. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the App shall be instituted exclusively in the courts of England and Wales, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.
14. Waiver and Severability
No waiver by us of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
15. Entire Agreement
These Terms, our Privacy Policy, and any other agreements expressly incorporated by reference herein constitute the sole and entire agreement between you and My Feline regarding the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the App.
